Upicus guarantees compliance with current regulations on the protection of personal data, reflected in Organic Law 3/2018, of December 5, Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD). It also complies with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons (GDPR).

This privacy policy explains what personal data Upicus collects through this website and the KDimension application, how it processes it and for what purposes. Specifically, it describes our practices with respect to the following:

 

1. What personal data do we collect?

Upicus collects data from you through the use of this website, our interactions with you and the use of the KDimension application. Some of this data is provided to us directly by you (for example, by creating your user account or submitting a form), and some is obtained by us by collecting data about your interactions and use of KDimension. The data we collect depends on the context of your interactions with KDimension and the choices you make, including those regarding your privacy settings and the features you use.

The data we collect may include:

  • Name and contact information. Your first and last name, email address, location (country, province, city, postal code), telephone number and other similar contact information.

  • Credentials. Password to access your KDimension user.

  • Demographic data. Data about you, such as your age or gender.

  • Shopping in the store. Data related to purchases made in the KDimension store, your active subscriptions and credit card data used.

  • User account. Data to identify your KDimension user account and the information associated with it.

  • Interactions. Data about the use of KDimension. In some cases, this is data that you provide to be able to use KDimension. In other cases, such as bug reports, this is data that we generate. Other examples of interaction data are as follows:

    • Device and Usage Data. Data about your device and the KDimension features you use, including information about the hardware and software, and how KDimension works, as well as its settings. For example:

      • Device data, connectivity and configuration. Data about your device and its configuration. For example, data about the operating systems and other software installed on your device or the IP address.

      • Data from nearby devices and networks. Data about Bluetooth devices and nearby Wi-Fi networks. These data are only collected with the express authorization of the user.

      • Data about how you use KDimension. Data about KDimension usage activity, such as knowing when you have connected to the application, which features you use most frequently, and looking for usage patterns in order to improve the application in future updates.

      • Bug reports and performance data. Data about KDimension’s performance and any problems you experience, including bug reports. Bug reports may include details of the software or hardware related to a bug.

      • Troubleshooting and help data. Data you provide when contacting Upicus for help, such as the features you use and other details that help us provide technical support. For example, contact data or data about the status of your devices.

  • Activity. Data about the activities and experiences you do in KDimension. For example, the exercises you do and their order, how you have solved the exercise, failures and successes obtained and time spent on each of the exercises.

2. Who is responsible for data processing?

3. For what purpose do we use the data?

Upicus uses the data we collect to:

  • Provide our product or service, including updating, securing, troubleshooting, and providing technical support.
  • Improve and develop our product. We use data to continually improve our product, including adding new features or functionality. For example, we use bug reports to improve security features or usage data to determine which new features to prioritize.

4. What are the legitimate bases for data processing?

5. Where do we store and process the data?

We store and process the data on our own servers located in Spain and on servers of external providers located in the European Union.

6. How long do we keep the data?

In compliance with the RGPD and the LOPDGDD, Upicus keeps your personal data only for the time necessary to fulfil the purpose for which they were collected, according to the principles of “limitation of the conservation period”, “purpose” and “legitimacy”. of the treatment”, as well as to the specific laws that establish their own conservation periods for the related data.

In line with the above, as a general rule, the data will be deleted once the purpose for which it was collected has been fulfilled and there is no longer any relationship between the interested party and Upicus, such as contracts, pending invoices, etc., in which case the data would be kept for said purpose. Those data that by legal imperative must be kept for a certain period would also be kept, which would be deleted at the end of said period.

7. With whom do we share the data?

Your data may be shared with other companies in our group, but we do not do so for commercial purposes or share your data with third parties. In case of doing so, we would ask for your prior express consent.

9. Collection of data from minors

Currently, we do not collect data from minors. If we discover that we have mistakenly obtained personal information from a minor, we will delete such information as soon as possible.

11. Use of cookies and other tracking technologies
